General Conditions of Use

You agree to be bound by these Terms and our Privacy Policy, which may be updated from time to time, by using the Platform or any of our services.

Concerning SamedayGP

In order to enable telehealth services, SamedayGP (referred to as “SamedayGP,” “we,” “us,” or “our”) offers an online platform that links patients (referred to as “Patients”) with Australian registered healthcare practitioners (referred to as “Doctors”). With the help of our telehealth services, patients can get associated services and medical attention over the phone . In order to provide these services, healthcare professionals consult with patients virtually and other technology, all without having to see the patient in person.

Not Advice for Health or Medicine

Please be aware that, unless otherwise specified in these Terms, SamedayGP is not a medical or healthcare provider, and we assume no liability for any medical or healthcare services—including Telehealth Services—obtained over the Platform. It is imperative to speak with a healthcare practitioner for any questions regarding medicine or healthcare in general. The information on the Platform should not be used as a replacement for customized counsel from a licensed healthcare professional, with the exception of information supplied by healthcare practitioners during consultations.

Services Not Emergency

The Platform’s services are unsuitable for treating serious medical illnesses, medical crises, or circumstances requiring prompt medical attention (collectively, “Emergencies”). Should you require emergency medical attention due to a significant medical problem, call 000, or go to the closest hospital emergency center.

Not a Replacing Continued Medical Care

The continuous care given by your general practitioner (GP), who is in charge of handling your normal healthcare needs, is not intended to be replaced by our services, including Telehealth Services. In order to ensure comprehensive healthcare management, we strongly advise patients to make follow-up appointments with their primary care physicians.

Correctness of Patient History and Information

When completing assessments of treatment appropriateness and drug suitability, comprehensive and truthful answers are essential to the effectiveness of telehealth services. In addition to providing accurate and thorough information, patients (or their guardians, if applicable) must disclose any new symptoms or changes in their condition since their last consultation.

Restrictions on Indemnity and Liability

You understand and consent to the following:

– Medical advice or care given by healthcare professionals is not our responsibility.
– We disclaim all liability for any direct, indirect, special, punitive, incidental, exemplary, contractual, or consequential damages resulting from your use of the Platform, to the fullest extent allowed by law.
You agree to hold us (as well as our affiliated companies, officers, workers, and consultants) harmless from any and all claims, actions, losses, liabilities, and costs arising from: – Any treatment, advice, or information given by a healthcare practitioner during consultations and other services (including the quality of care and prescribed medications).
– Accidents, personal injuries, or malpractice on the part of any healthcare professional.
– Not giving accurate responses or supplying necessary data.
Utilizing services offered by the platform.
To the extent authorized by law, we disclaim all implied rights, remedies, conditions, promises, and warranties.

Making Use of the Platform

You accept and consent to the following by using the Platform:

– You are the patient’s parent, guardian, or health attorney, or you are at least eighteen years old.
– The patient’s symptoms are neither exceptional nor dangerous.
The necessity for the Consultation is not connected to any mishap or harm.
– The patient is not taking more than one prescribed medicine and does not have any severe or multiple chronic conditions.
– You have answered all of the “Patient General Medical Questions” honestly and completely, leaving out no pertinent details.
– There is no guarantee that the medical advice given during a consultation will be of high quality.
– Prescriptions for medications cannot be shared by patients with other people.
– You will protect the login credentials for the Platform.
– We maintain the right to terminate your Platform registration.
– You will let us know right once if a healthcare provider gives a prescription for medicine or treatment and the patient notices any negative affects.
– You’ll abide by Australian law when using the Platform.
– You shall adhere to privacy regulations when handling other people’s personal information.
– No content containing trojan horses, worms, viruses, or other dangerous applications will be loaded or published by you.

Remittances

The Platform offers payment options, and by using it, you accept responsibility for paying all fees and charges in line with these Terms and any applicable fees and charges. Additionally, you consent to our processing the money at the time of booking to confirm the appointment using the credit or debit card you have supplied.

Refunds for Telehealth Consultations

All of the doctors we work with are licensed medical professionals in Australia who have undergone screening to ensure they offer the finest patient care and customer service. Like conventional doctors, they are committed to providing high-quality advise and usually do not provide refunds for their professional services. They are, nevertheless, completely covered in the event of unforeseen medicolegal claims. A doctor may, at their discretion, think about returning the consultation money if they feel that the patient needs a real, in-person consultation or if they are unable to help.

Cancellations: If you want to cancel your appointment, there will be no reimbursement for same-day reservations.

Furthermore, we respectfully ask that you give us at least one business day’s notice if you need to cancel an appointment that you have scheduled in advance. If an advance appointment is canceled with less than one business day’s notice, the entire appointment cost will be charged.

In the following scenarios, the consultation money will be reimbursed: – If the staff member or the healthcare provider cancels the appointment.
– In the event that a technical malfunction prevents the healthcare practitioner or our team from assessing and logging an effective consultation.

Non-Attendance: After scheduling an appointment, you will receive an email or text message with the further instructions for the consultation. 

It is your duty to always have your phone close at hand in case the call comes in. The caller ID on the call could be secret or absent.

– If you supplied the emergency person’s details while booking, the doctors will try to get in touch with them. They will also make at least one or two calls. If communication is not established, including with inaccurate cellphone number information, the appointment will be deemed unattended and the cost will not be reimbursed.

Refunds: If applicable, refunds will be sent to the card that was used to make the purchase via the online payment gateway. Refunds could take up to five business days to show up on your credit card statement.

Medical certifications, prescriptions, and referrals

You can choose your chosen pharmacy for both dispensing and collection of prescription medications that have been prescribed by a doctor. Prescription pills are supplied to you by email or SMS.

You will receive medical certifications, letters of recommendation, or any other pertinent documents agreed upon by the healthcare provider by email or text message. These can be viewed and downloaded using our mobile apps.

Doctor Consultations and Availability

The availability of a healthcare practitioner at the appointed time cannot be guaranteed. We will make an effort to locate a replacement in the event that a healthcare practitioner is unable to see you, and we will notify you of any cancellations. We respect the choices of patients for Healthcare Practitioners (e.g., gender, language), and we will try our best, depending on availability, to fulfill their requests. Health professionals try to diagnose and suggest treatment plans during consultations, which last up to 10 minutes. However, patients are free to cancel the consultation at any point, although they will be charged for the whole 10 minutes. Healthcare professionals have the right to discontinue, reschedule, or reject treatment at any moment, and more severe medical issues could call for extended consultation periods that cost extra.

Utilizing Instruments of Communication

The healthcare provider may choose to conduct consultations via phone. Consultations do not involve email, instant messaging, or fax machines; however, post-consultation documentation may require your email address and phone number. Any correspondence between patients and healthcare practitioners must take place during the allotted consultation time; if it doesn’t, the healthcare practitioner must give written consent.

Evaluations

We might ask you to post reviews of our services on the Platform on a regular basis. Please be aware that we have the right to utilize any content you provide. You pledge not to say or do anything negative that would damage our goodwill or reputation.

Ownership of Intellectual Property

The Platform is our sole property and is shielded against infringement by intellectual property laws, together with all of its features, content, and functioning. We retain all intellectual property rights pertaining to comments you provide us about the Platform. You are not permitted to access or use any portion of the Platform, services, or materials for commercial purposes. You may only use the Platform for personal, non-commercial purposes.

The laws of South Australia apply to these Terms. The non-exclusive jurisdiction of the South Australian courts and courts that are able to accept appeals from those courts is acknowledged by both parties.
